Terms of Agreement

Welcome to Hive Subleasing (HS). We (HS) hope you find this informative. By using our services and website or any associated content/postings you agree to these Terms of Agreement (TOA). You agree that Hive Subleasing is a private website. If you are accessing or using HS on behalf of a business, you represent and warrant to HS that you have authority to accept the TOA on behalf of that business and that that business agrees to the TOA. If you do not agree to the TOA, you are not authorized to use HS or download the App. We may modify the TOA at any time at our sole discretion. You are responsible for periodically checking for changes and are bound by them if you continue to use HS. Our privacy policy and all other policies, site rules, and agreements referenced below or on HS, are fully incorporated into this TOA.

USE. As a user of HS you agree that you are 18 years of age or older and your listing property is present in the United States. You agree as a user of HS that you will only post one listing at a time; you must have notified your landlord and/or housing management company about subleasing, and have been granted permission to sublease. HS has full control over all posting on HS website and is authorized to delete any posting at any time. HS will delete all postings that have been on HS greater than 7 months from the Start Date listed. HS does not authorize any lease or sublease between any parties. Use of HS does confer consent or agreement to act without the full consent of the parties in any lease or sublease agreement. User’s of HS agree that the use of HS is allowed and agreeable by the owner or landlord of the property. All information provided on HS is supplied by the contracting parties NOT HS and HS bears no responsibility for any misrepresentations. All negotiations and pricing discussions are between the parties and HS is not a party nor does HS have any decision authority in such negotiations or discussions. HS has no control or authority in any lease or sublease agreement. HS is a listing service only and is a platform to be used to connect parties regarding a sublease. These limitations to not restrict HS from any future use as it may see fit not contained in this agreement. HS maintains the right to change these terms at any time. HS is a platform for listings and posts and HS is not responsible for managing, paying for, or fulfilling any sales that result from your Product Listings. By using HS you agree that you will only post the property and the relevant property information. You agree that you will not post information regarding any other object including but not limited to clothes, furniture, or cars on or near the property. 

DISCLAIMER, LIABILITY, CLAIMS, and INDEMNITY. To the full extent permitted by law, HS and its officers and directors, (1) make no promises, warranties, or representations as to HS, including its completeness, accuracy, availability, timeliness, propriety, security or reliability; (2) provide HS on an “AS IS” and “AS AVAILABLE” basis and any risk of using HS is assumed by you; (3) disclaim all warranties, express or implied, including as to accuracy, merchantability, fitness for a particular purpose, and non-infringement, and all warranties arising from course of dealing, usage, or trade practice; and (4) disclaim any liability or responsibility for acts, omissions, or conduct of you or any party in connection with HS. In the event that HS acquires, buys, or has significant shares in any other corporation, partnership or business, this TOA apply to said company, partnership or business as if it were HS. 

You acknowledge under the fair housing act that you will not discriminate against race, gender, age, religion or any other category prescribed by law. By using HS you agree not to copy/collect HS content via robots, spiders, scripts, scrapers, crawlers, or any automated or manual equivalent (e.g., by hand), and that any misleading, unsolicited, and/or unlawful postings/communications/accounts are prohibited, as is buying or selling accounts. You agree not to post content that is prohibited by any of HS’s policies or rules referenced above (“Prohibited Content”). You agree not to abuse HS’s flagging or reporting processes. You agree not to collect HS user information or interfere with HS. You agree we may moderate HS access/use in our sole discretion, e.g., by blocking, filtering, re-categorizing, re-ranking, deleting, delaying, holding, omitting, verifying, or terminating your access/license/account.

TRADEMARKS: Hive Subleasing, “HS” and the hive symbol with three bees and all other HS content, posted on HS website, are property of Hive Subleasing, and may not be used without the specific consent and/or authorization.

TERMINATION. You agree that we may, under some circumstances and without prior notice to you, terminate your use of and access to any of the parts of the HS. Some of the reasons for such termination may include, but are not limited to, (a) a breach or violation or suspected breach or violation of this TOA (b) a request by law enforcement or another government agency, (c) our decision to discontinue or change all or part of HS, (d) technical or security issues, and (e) fraudulent or illegal activities. All terminations will be made in our sole discretion and you agree that we will not be liable for any termination of your use of or access to the HS sites or any part of the HS.

FEES. When you make a paid posting (cl.com/about/help/posting_fees), you authorize us to charge your account. Any tax is additional. Fees are non-refundable, even for posts we remove, delay, omit, re-categorize, re-rank, or otherwise moderate. We may refuse any posting.

UPDATING TERMS. We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service) before we make changes to these Terms and give you an opportunity to review them before they go into effect. Then, if you continue to use the Service, you will be bound by the updated Terms.
